It's not particularly useful but I don't see how you can argue with the
spec. If it says that elements are in no namespace unless explictly
declared to be in a namespace then presumably that is the case, by
definition. 

(Even if the only sensible way to interpret these things is to treat
them as if they were in a namespace with either no name or name "").

That. (phrases like that appear most weeks on xsl-list in answer to user
questions:-)
